Terms and conditions

These terms are the basis of all rental/service agreements conducted through hire-anything.
The below provide standard terms and conditions agreed by the lender/service provider and borrower / customer.
However, they may be add to, extended, altered, and overridden by either party as required. These terms form part
of, and should be read and interpreted as part of, the hire-anything site usage terms and conditions
1. Host: the owner of the goods (or person with rights to lend or hire out) - referred to here as host and also known
as hirer agent.
2. Service provider: Any person or company providing professional, trade or other services.
3. Borrower/Customer/Client: the person who accepts possession of the goods or services for a period of time -
referred to here as borrower or lessee, and also known as hiree, lettee, user
4. Resource: any asset or item being lent, let, leased, or hired to the borrower by the lender
5.Agreement: the deed of use negotiated and agreed by the lender and the borrower through hire-anything
6.Members agree to adhere to the specific terms and conditions defined and outlined by them in any
specific agreement which will prevail in case of contradiction with these standard terms and conditions. In the case
of absence of specific terms and conditions, members agree to adhere to these standard terms and conditions.
7. The borrower/customer/client agrees to repair or replace (or pay for repair or replacement) for any damage or loss
to any resource incurred whilst the item is in their possession. Damage or loss does not include reasonable wear and
tear.
8. The borrower/customer/client agrees to pay to the lender all hire fees, bonds, deposits, and other costs as agreed
(in loan documents negotiated on hire-anything or as negotiated otherwise).
9. hire-anything is not responsible for any deposits paid or insurance or warranty towards any item or service
provided. The Host/Owner/Service Provider and the Borrower/Customer/Client must agree and deal with payment,
collection and return of any deposits as well as deal with any required insurance/warranty for items or services. Any
loss of funds by either party engaged in a transaction is not responsibility of hire-anything.
10. The host has a duty to warn of known defects or limitations of the goods.
11. The host must expressly state any limitation on the use of the goods.
12. The borrower/customer/client agrees to inform the host of any intended use of the item that may be considered
outside the standard use.
13.Borrower/customer/client agree to only use borrowed/hired items in the manner allowed and agreed in any
agreement, or as otherwise negotiated and agreed.
14. Borrower/customer/client agree not to re-lend or re-hire any items without the express written permission of the
owner
15. Should a claim of damage be placed by the host, it is responsibility of the borrower/customer/client to deal with
the matter. It is strongly advised that all parties understand the liabilities and take up the required insurances via
respective companies to provide adequate coverage before making any payments and entering into any agreements.
16. Any exclusion of liability by the borrower/customer/client must be clear and unambiguous.
17. The host and the borrower/customer/client agree that, unless otherwise stated by the Host, there may well be no
implied insurance cover for any item lent or hired out. It is strongly advised that all parties understand the liabilities
and take up the required insurances via respective companies to provide adequate coverage before making any
payments and entering into any agreements.
18. The borrower/customer/client agrees to return resources in their issued/received condition, on or before the
agreed date. The borrower/customer/client agrees to communicate in advance to the resource host any likely
inability to do this. The host and the borrower/customer/client to try and agree an appropriate, fair, and workable
resolution.
19. Customers agree to pay any host related fees, cancellation fees, insurance excesses, and any other liabilities as
required by the host and stated and agreed upon in the agreement, with the exception to fees payable directly to
hire-anything.
20.The borrower/customer/client and host agree that hire-anything is in no way party to any lending, borrowing,
hiring or service transaction conducted through hire-anything, and that they in no way will seek to make any such
claim.
Jurisdiction & Governing Law - transactions
The terms and conditions of any agreement between lender / service provider and borrower / customer done through
hire-anything will be governed by, and construed in accordance with, the laws of the region where the item/service
provided is domiciled.
